Terms of Service

One term matters more than all the others, so it goes first and it is not buried: Well Spent is a projection tool, not financial advice, and it will be wrong about the future.

These terms are an agreement between you and Matt Warden, an individual based in Tennessee, United States ("we", "us"), covering Well Spent at wellspentyears.com (the "Service"). By using the Service you accept them. If you do not, don't use it.

1. What Well Spent is, and what it is not

Well Spent runs a retirement simulation against historical market data and shows you what it produces. That is the whole of it.

It is not financial, investment, tax, legal, accounting, or retirement advice, and it is not a recommendation to buy, sell, or hold anything. We are not a registered investment adviser, a broker-dealer, a bank, or a fiduciary of any kind, and using the Service does not create an advisory or fiduciary relationship between us. Nothing here is personalized to your circumstances, because the Service does not know your circumstances.

Specifically, the model does not know about:

  • your taxes, in any form — no bracket, no capital gains, no required distributions;
  • Social Security, pensions, annuities, or any other income you expect;
  • your house, your mortgage, your debts, or anything else illiquid;
  • your health, your insurance, or the cost of long-term care;
  • your spouse or anyone else whose money is entangled with yours.

Past performance does not predict future results. The historical record the model runs on is a sample of one, and the future is entitled to be worse than anything in it. Every projection is a conditional statement about a future that has not happened, and it should be treated as one. How the numbers are made sets out every source and assumption so that you can check the model rather than trust it.

Decisions you make with your money are yours. Consult a qualified professional before acting on anything you see here.

2. Who can use it

You must be at least 18 and legally able to enter a contract. Signing in requires a Google account, and your use of that account is governed by Google's terms, not ours. You are responsible for keeping your own device and Google account secure; anyone who can sign into your Google account can see your plan.

Give us accurate information if you want accurate output. The Service takes what you type at face value and cannot detect a typo in your net worth.

3. Your data and your content

The figures and notes you enter remain yours. You grant us only the permission needed to operate the Service for you: to store your data, and to process it to produce your projections and your history. We do not use it for anything else. What we collect and how to have it deleted is set out in the Privacy Policy, which forms part of these terms.

4. Acceptable use

Don't:

  • try to access another person's account or data;
  • probe, scan, or attack the Service, or attempt to bypass authentication or rate limits;
  • scrape or automate against the Service in a way that degrades it for other people;
  • resell the Service, or present its output to others as personalized financial advice you are qualified to give;
  • use it for anything unlawful.

If you find a security problem, email privacy@wellspentyears.com rather than exploiting it. Reports made in good faith are welcome.

5. Availability and changes

The Service is free, provided as-is, and offered with no uptime commitment. We may change, suspend, or discontinue any part of it, and we may change the model, the data sources, or the assumptions as better data becomes available — projections you saw previously may not reproduce exactly. If we ever shut the Service down, we will give at least 30 days' notice by email to signed-in users so that you can retrieve your data.

Keep your own copy of anything you cannot afford to lose. Your snapshot history is not a system of record for your finances.

6. Third-party services

The Service depends on Google for sign-in and Cloudflare for hosting, and links to outside sources such as the datasets the model uses. We are not responsible for those services, their availability, or their content.

7. No warranties

The Service is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of defects, that its calculations are free of error, or that its output is suitable for any decision you are contemplating. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

8. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, investment losses, lost savings, lost data, or other financial loss, arising out of or relating to your use of the Service — whether or not we were advised such loss was possible.

Our total liability for any claim relating to the Service will not exceed one hundred United States dollars (US$100). The Service is free, and this limit is a condition of offering it at all. Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you.

9. Indemnity

You agree to indemnify and hold us harmless from claims and costs arising out of your misuse of the Service, your breach of these terms, or your presentation of the Service's output to another person as advice.

10. Ending it

You can stop using the Service at any time, and can have your account and data deleted by emailing privacy@wellspentyears.com. We may suspend or terminate an account that breaches these terms or that puts the Service or other users at risk. Sections 1, 3, and 7 through 12 survive termination.

11. Changes to these terms

If these terms change, the effective date at the top changes with them, and material changes are emailed to signed-in users before they take effect. Continuing to use the Service after that means you accept the revised terms.

12. Governing law

These terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Tennessee, and you and we consent to their jurisdiction. If any provision is held unenforceable, the rest stays in force. These terms, together with the Privacy Policy, are the entire agreement between us about the Service.
